Passage of the PRO Act by the full U.S. House of Representatives is the biggest shot across the bow to independent contractor status in recent history.

One of the core issues for the Direct Selling Association (DSA) and direct selling throughout our storied history has been protecting the independent contractor status of the salesforce. When legislation goes to undermine that relationship, it has the potential to throw into disarray our way of doing business. H.R. 842, the Protecting the Right to Organize (PRO) Act, would do just that.

The loss of TikTok as a potential tool for reaching the dynamic Gen Z market is a blow to the channel.

Most concerning is the prospect that TikTok’s decision will act as a bellwether for platforms more vital to the direct selling channel, such as Facebook and YouTube.

The social media platform TikTok took the direct selling channel by surprise in December 2020 when it announced a sweeping addition to its community guidelines that included a ban on multi-level-marketing content. It is the first online social platform to place an outright prohibition on direct selling and MLM activity.

Because the industry made the bold decision to commit to third-party self-regulation when it did, DSSRC was able to socialize its goals and objectives with direct selling companies and familiarize the industry with the program’s jurisdictional purview and process of review before the coronavirus hit.

The direct selling industry worked diligently and cooperatively to establish and implement an industry self-regulation program that celebrates its third year this month. The BBB National Programs’ Direct Selling Self-Regulatory Council (DSSRC) administers that program, helping direct selling companies across the industry abide by the high standards first established by the Direct Selling Association (DSA) Code of Ethics.
